Jury Awards Family of Child Injured During Dental Care $95.5 Million

In 2018, the family of a 4-year-old girl sought treatment for her in a Texas dental clinic. The child needed a root canal and a crown placed. The patient was restrained using a papoose board and the dentist began removing the caries lesion. The child underwent a seizure during the treatment and suffered irreversible, severe brain damage as a result; her condition requires round-the-clock medical care. The dental team did not call 911 until 5 hours after the child initially began seizing. The Texas Dental Board revoked the dentist’s license due to “intentionally and knowingly by omission (causing) serious bodily injury to a child by failing to seek and provide adequate medical attention,” and the family filed a wrongful death suit.
