Massachusetts Dental Patients Receive Rebates Due to Dental Loss Ratio Law

The state’s dental loss ratio law requires insurers to spend at least 83% of premiums on patient care and other states are taking notice.

On November 22, 2022, Massachusetts voters passed the dental loss ratio law, becoming the first state to enact such legislation. The law went into effect on January 1, 2024, and Massachusetts is now the first state to provide a rebate to patients. The $14.5 million will go back to consumers because insurance companies did not meet the required dental loss ratio standard.

The dental loss ratio standard mandates dental insurance companies to allocate a set portion of premiums toward patient care, with penalties for underperformance and enhanced transparency requirements. The move responds to concerns about insurers retaining substantial premiums for administrative expenses, rather than directing funds to patient care. Inspired by Massachusetts’ pioneering implementation, this legislation has passed or is being considered by 13 other states.
