Dental Practice Is Hit With Lawsuit Due to Unwanted Calls and Texts
Coast Dental gets drilled with a $3.8 million lawsuit settlement over unwanted marketing calls and texts, with eligible consumers choosing between $59 cash and a free power toothbrush.
Ouch! Coast Dental will pay more than $3.8 million to settle a class action lawsuit because it violated both the federal and the state of Florida’s Telephone Consumer Protection Act. The settlement money will go to those who opted out of contact with the dental practice but still received more than one phone call or text message over a 12-month period. The calls and text messages encouraged recipients to schedule a dental appointment with Coast Dental.
The lawsuit alleges that Coast Dental, a dental support organization (DSO) with practices in Florida, Georgia, and Texas, made phone calls and sent text messages that were unsolicited, which is banned by these acts. Consumers must opt in to receive messaging from a particular company before marketing appeals may be dispersed.
The DSO does not admit to any of the charges but, rather, is choosing to settle the lawsuit in an effort to resolve it quickly. Per the settlement, consumers who were part of the class action suit may choose $59 cash or a free power toothbrush sold by the practice for $99. Consumers must choose their option by October 30.
